Justice

De betekenis van de zin: “een rechter heeft beslist” is soms nihil.
Dit wordt duidelijk aan de hand van wat belicht wordt in deze website.
De perceptie nopens justitie is fout.
Er is de zich niet voor te stellen kloof tussen de werkelijkheid en het beeld die men er van maakt.

Wanneer je het slachtoffer bent van een unfair systeem, dient men te kijken of de zaak wettelijk deugt.

Een ketting is net zo sterk als zijn zwakste schakel.
Een beslissing die wordt ingepakt in schone schijn – zoals de sigarettendoosjes die de foto’s op het pakje sigaretten verbergt – botst met de ethiek.
Snel geschreven vonnissen – zoals het officieel heet (cfr. het artikel in De Standaard zaterdag 21 mei 2016) of slechte  vonnissen, zoals dit vroeger heette, krijgen automatisch het label onbetrouwbaar, ze zijn aldus de facto waardeloos.
De werkwijze is verkeerd.

Zoiets merkt men aan het soort tekst in het vonnis.

Gedenk, het vonnis is niets meer dan een oordeel op afstand en soms gesteund op geen enkel werkelijk gegeven.

Justitie is geen magie, iets die men tevoorschijn tovert, of iets die zomaar steunt op een gerucht of veronderstelling of iets waarvan men weet het steunt op een fout beeld of onvolledige weergave.
Eén enkel gegeven kan een zienswijze helemaal veranderen.

Een oordeel of beslissing kan zo eng zijn dat men in een surreële, irrationele werkelijkheid terecht komt.

Een persoon met een goed karakter heeft zijn integriteit en kan niet in verband gebracht worden met iets die niet in de persoon ligt, zodat de rechtszaak nopens Liam Allan automatisch in elkaar tuimelde, op het moment dat tastbare gegevens aan de oppervlakte kwamen.

Men had kunnen merken dat die persoon op zijn 19e het niet in zich had beschuldigd te worden.
Het is niet iets die niet waarschijnlijk is. Men zit niet in een situatie van erkennen of ontkennen.

Een subgegeven wordt kunstmatig gebruikt en wordt de hoofdkwestie. Oorzaak en gevolg worden als het ware omgewisseld. Men komt in een werkwijze van absolute willekeur en het soort fouten waarmee men het leven van een een mens kapot maakt, zoals bij miscarriage van justitice. Betrokkene gaat dan door een jarenlange calvarie. Door onevenredige inzet komt men dan soms tot de vaststelling, het is de verkeerde persoon.

Abiding in the midst of ignorance, thinking themselves wise and learned, fools go aimlessly hither and thither, like blind led by the blind.

Volharden in onwetendheid, denkend wijs en geleerd, zoals gekken doelloos naar hier en daar, zoals de blinde de blinde leidt.

In een natuurlijke situatie spreken mensen met elkaar en komt men niet tegenover elkaar te staan.
Het gebruiken van een breekijzer in een situatie waar er niets is, om zich op te steunen is compleet zinloos.

‘Wie te veel nadenkt over de impact van te snel geschreven vonnissen, wordt gek’

Zijn we nog een rechtsstaat die naam waardig?

Wat gaat er werkelijk om achter de schermen van de Belgische justitie? We gingen op zoek naar het antwoord op een fundamentele vraag: kunnen rechters nog naar behoren rechtspreken in dit land? Zijn we nog een rechtsstaat die naam waardig? Het antwoord is ontstellend: neen.

Op de drukke secties van onze rechtbanken van eerste aanleg is het hozen. Neem de jeugdrechtbank in Antwerpen, waar elke jeugdrechter gemiddeld 450 kinderen en jongeren opvolgt. ‘Te veel om goed te zijn’, zegt jeugdrechter Philippe Vandaele. Het neigt naar bandwerk, klinkt het op veel rechtbanken.

Fouten

De lat gaat onvermijdelijk lager. De kwaliteit van de vonnissen neemt af, geven rechters toe – al wil niemand zo ver gaan om te zeggen dat ze hun eigen uitspraken niet meer vertrouwen. ‘Soms denk ik: dit had misschien beter gekund’, zegt een beloftevolle Gentse rechter. ‘Je neemt beslissingen met een grote impact op het leven van mensen. Als je daar te veel bij stilstaat, word je gek.’

Anthony Ray Hinton shares his story and discusses his book, “The Sun Does Shine” at Politics and Prose on 4/2/18. Hinton was twenty-nine when he was arrested on two counts of capital murder in Alabama in 1985. He was innocent, but he was also poor and black with an incompetent defense attorney. Hinton was convicted, sentenced to death by electrocution, and spent the first three years on death row in silent, bitter despair. Then he became determined to survive, and even to thrive. He kept his own spirits up by bolstering his fellow inmates, and found new representation with Bryan Stevenson, founder of the Equal Justice Initiative and author of Just Mercy. http://democracynow.org – Kalief Browder, who spent three years in jail in New York without ever being convicted of a crime, took his own life nearly one year ago, on June 6, 2015. In 2010, when Kalief was just 16, he was sent to Rikers Island on suspicion of stealing a backpack. He spent the next nearly three years imprisoned at Rikers, even though he was never tried or convicted. For nearly 800 days of that time, he was held in solitary confinement. A new piece in The New Yorker details how Kalief actually learned how to commit suicide at Rikers, after seeing another prisoner attempt to take his own life. The piece also details how, before taking his own life, Kalief recounted prison guards goading him on during suicide attempts, saying, “If you don’t jump, we’re going to go in there anyway, so you might as well go ahead and jump, go ahead and jump.” We speak with reporter and author Jennifer Gonnerman, who first recounted Kalief Browder’s story in 2014 in her article for The New Yorker, “Before the Law: A boy was accused of taking a backpack. The courts took the next three years of his life.” In her latest piece, Gonnerman details Browder’s experiences with suicide attempts at Rikers. “His description of Rikers and his time on Rikers was almost as if it were a school for suicide,” Gonnerman says.

The boy is dressed in all white, equipped with wings and even a halo, so the prank victims don’t realise he isn’t a statue when they approach with the loading dock. He gives them the scare of their lives, however, when he suddenly comes to life, gets up and runs away!
